These Terms and Conditions of Use and Sale (TCU) set forth the terms and conditions governing access to and use of the “120 Minutes to Sell” platform by all users.

The user is deemed to have read and understood these terms and conditions before accessing the site. Any user’s use of the platform implies full and unconditional acceptance of these terms and conditions, which the user must accept in order to create and access their personal account.

Users can access the Terms of Service at any time on the website.

These terms and conditions apply to the exclusion of all other terms and conditions.

Access to, browsing of, and use of the Site are strictly limited to individuals who are at least 18 years of age.

To access the Site, you must have a device connected to the internet. You are responsible for all costs associated with your digital environment (hardware, software, and network connection), including internet connection costs.

The current Terms of Service will take effect as of the date they are posted online. SAS 120 minutes pour vendre reserves the right to modify the Terms of Service at any time. If any provision of these Terms and Conditions of Sale is found to be invalid under applicable law or by a final court decision, it shall be deemed unenforceable, without thereby rendering the remaining provisions invalid or affecting the validity of these Terms and Conditions of Sale.

3. Definitions

In these Terms and Conditions of Use and Sale, the terms used have the following meanings:

  • “User” means any user who browses, views, lists for sale, bids on, and/or purchases an item listed on the site.
  • "Service" means any service offered on the website.
  • “Website” refers to the infrastructure developed by the seller using Internet-compatible formats, comprising various types of data—including text, audio, still and animated images, videos, and databases—intended to be accessed by users to learn about the seller’s services.
  • "Seller" refers to the person listing their property for sale on the website.
  • "Buyer" means the person who won the auction through the platform and to whom the item is therefore awarded.

4. Role of the 120 Minutes Platform in Sales and Disclaimer

120 MINUTES TO SELL is a platform that allows users to list properties for sale and collect bids on properties listed by professional sellers (notaries, real estate agents) or private individuals in a virtual auction room.

120 MINUTES TO SELL accepts only offers intended to lead to the signing of a preliminary sales agreement, which must be followed by the signing of the final sales contract at the notary’s office.

It shall not constitute a notarial or judicial auction resulting in a final sale.

Under no circumstances may the website be considered an intermediary, and it cannot be held liable, even in part, for the conduct of the transaction.

An application for approval, including general and specific terms and conditions, must be submitted in order to submit a bid.

120 MINUTES POUR VENDRE cannot be held liable for any lack of quality or accuracy in the information contained in the listings. The same applies to all editorial content.

5. Registration

Access to certain Services requires the creation of a personal account.

Registration is free. To register, please fill out the online form provided for this purpose. To do so, you must provide the following information:

  • Last Name
  • First name
  • Phone
  • Email address

Please note that the Île-d’Yeu area (85350) is excluded from the sale.

You agree to provide accurate and truthful information about yourself.

A confirmation email will then be sent to the address you provided, containing a summary of your login information.

Your login ID is personal and may not be used by more than one person, nor may it be sold, rented, or transferred in any way.

Your password is confidential and must not be shared with anyone else. You can change it in your account settings. You must take all necessary steps to protect your password.

You also agree to notify 120 Minutes pour vendre, by any means and as soon as possible, if you discover or suspect any fraudulent or unauthorized access to your account.

You can request to unsubscribe and have your account deleted at any time through your personal account or by sending an email to the following address:

Except as provided in Article 8, 120 Minutes pour vendre reserves the right to terminate your account without notice or refund in the event of a violation of these Terms of Use, including but not limited to:

  • In the event of use that violates applicable law;
  • In the event of fraudulent use or identity theft;
  • In the event of a violation of the rights of 120 Minutes to Sell or of a third party.

120 Minutes to Sell may also delete your account if it remains inactive for more than one (1) year.

6. Procedure for purchasing real estate

Any order placed on the website constitutes a binding purchase agreement.

By placing an order, you agree to the descriptions of the products available for sale and the prices in effect on the date of the order.

The order will not be definitively submitted until the summary screen is confirmed. This action is equivalent to a handwritten signature as referred to in Article 1367 of the Civil Code and constitutes the conclusion of a distance contract in electronic form within the meaning of Articles 1127-1 and 1127-2 of the Civil Code.

A. You visit the property you're interested in

The first step is to visit the property that has caught your eye.

  • During this visit, you can confirm your interest in the property by agreeing to the terms and conditions for participating in the sale directly through our platform. You will sign an application for approval, which includes general and specific terms and conditions, in order to submit an offer.

B. We are confirming your participation in the interactive auction

Before the bidding period begins, you can view the listings on 120 Minutes to Sell and follow the necessary steps to confirm your participation.

Once you have completed your registration form and received confirmation via email, you will be ready to submit your bids.

C. Place your bid on the item you want

During the bidding period (the duration of which is set by the seller, typically 120 minutes), you can submit your bids online, one after another.

Each bid must exceed the previous one by the specified increment. To ensure transparency and fairness, the anonymity of participants is strictly maintained.

The procedure consists of two steps:

  • Create an account
  • Confirmation of eligibility to participate

This registration must be completed before the bidding period begins.

Unfortunately, late or incomplete registrations cannot be accepted.

Online bids submitted by interested parties are then received in real time by approved potential buyers.

The seller is free to choose whichever offer they wish, with no obligation to accept, even if the reserve price is met. Only formal acceptance or the signing of the preliminary agreement binds the seller.

7. Right of withdrawal

In accordance with Article L. 221-28, paragraph 1, of the Consumer Code, the right of withdrawal does not apply to distance contracts for the provision of services that have been fully performed before the end of the withdrawal period and for which performance began after the consumer’s prior express consent and express waiver of their right of withdrawal.

Once an order has been confirmed, no refunds will be issued for any services purchased.

8. Protection of Personal Data

120 Minutes pour vendre permits the creation of hyperlinks to the Site, provided that the source site does not contain any illegal, violent, or pornographic content, and excluding any use of such links for commercial or advertising purposes. 120 Minutes pour vendre reserves the right to object.

12. Complaint

Attempting to resolve the dispute amicably is a mandatory prerequisite before referring the matter to a mediator. 14. Governing Law and Jurisdiction in the Event of Disputes

The language of this contract is French. These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have exclusive jurisdiction. Only the French-language version of these terms and conditions shall be deemed authentic for the purposes of their interpretation.

In the event of a dispute regarding these terms and conditions or the sale, the parties shall endeavor, to the extent possible, to resolve the dispute amicably.

If the parties cannot reach an amicable agreement, the court with jurisdiction is the court in the defendant’s place of residence.
